Weeks after condemning the unlawful demolition of the Oke Ira community in Igbogbo, Ikorudu, Lagos State,
Spaces for Change [S4C] has filed a suit before the High Court of Lagos State in Suit Number: ID/9141GCMW/2022 challenging the unlawful demolition of the community. On May 31, 2022, the community was thrown into panic and confusion when Lagos State Ministry of Physical Planning and Urban Development officials, security operatives and hoodlums demolished houses in the community in brazen disregard for due process and human rights safeguards. The suit, CHIEF JAMIU ADEWUSI & 5 ORS (on behalf of themselves and the entire Oke Ira, community) VERSUS Lagos State Ministry of Physical Planning and Urban Development, Lagos State Building Control Agency, Commissioner of Police, Lagos State, The Governor of Lagos State, & The Attorney General, Lagos State, seeks the following reliefs:
1. A DECLARATION that the demolition of the Claimants’ residential houses at Oke – Ira Community, lgbogbo, Ikorudu, Lagos State on the 31’May, 2022 is unlawful and illegal,
2. AN ORDER OF COURT directing the Defendants to jointly and severally pay the sum of One Billion, Six Hundred and Sixty-Six Million, Six Hundred and Three Thousand, Eighty-Seven Naira (N1,668,603.087) being aggravated damages suffered by the claimants as a result of the demolition carried out by the defendants, their agents, servants, and privies on the claimants properties.
3. AN ORDER OF COURT directing the Defendants to jointly and severally resettle the affected persons in suitable housing accommodation.
4. AN ORDER OF PERPETUAL INJUNCTION restraining the Defendants by themselves, their agents, servants, privies and person claiming through them from committing any further acts of demoLition on the land.
The matter was filed on September 30 at a time Lagos courts are on vacation. With bated breath, the plaintiffs look forward to having a day in court when the courts resume.
